Recently, the 9th U.S. Circuit Court of Appeals threw out California’s ban on high-capacity ammunition magazines.
The court ruled the law violates the U.S. Constitution’s protection of the right to bear arms.
Judge Kenneth Lee ruled that California’s ban on magazines with over a 10-round capacity “strikes at the core of the Second Amendment — the right to armed self-defense.”
But, even after the ruling, gun owners can’t immediately buy high-capacity magazines.
That’s because a stay issued by a lower court judge remains in place.
California Gov. Gavin Newsom defended the law as a vital gun violence prevention measure, which, of course, is nonsense.
The ruling has national implications because other states have similar restrictions.
But, this ruling only applies to Western states under the 9th court’s jurisdiction.
The 9th Court’s decision upholds a 2017 ruling by San Diego-based U.S. District Judge Roger Benitez.
Judge Benitez blocked a new law that would have barred gun owners from possessing magazines holding more than 10 rounds.
But he and the appeals court went further, declaring unconstitutional a state law that had prohibited buying or selling such magazines since 2000.
That law had let those who had the magazines before then keep them, but barred new sales or imports.
Gun groups estimate that more than a million high-capacity magazines flooded into California before the ruling three years ago.
So, once the stay from the lower court expires, you can expect a buying frenzy on these magazines.
